Or what if there are no more Estates, must I gain a Duchy? What if there are exactly 1 or 2 Estates?

I would assume you can choose to gain a Duchy and fail to do so. IE, you are not required to choose one option. Think Torturer with Curses depleted.

I think the better comparison is with Tournament, which has exactly the same wording ("gain an X or a Y") and where the FAQ specifically states you can choose a pile that is already empty.

You can still choose Duchy.
