Can you choose a non-supply card with Smugglers?

If your opponent gained a Curse and a Spoils last turn, and you play Smugglers, can you choose the Spoils, and then fail to gain it because it's not a supply card? I know it was stated previously that Workshop and Smugglers are different in that Smugglers would allow you to choose an empty pile and then fail to gain it. Does non-supply card work the same as empty pile here?

Smugglers has you pick a card (costing <= $6) your opponent gained last turn. Then you try to gain a copy of it [from the supply]. If you picked a card of which a copy cannot be gained from the supply, then nothing happens.

Smugglers doesn't let you pick an empty pile (it doesn't let you pick a pile at all). The reason Smugglers works differently from Workshop is the way they specify the set from which they ask you to make a selection. Workshop (implicitly) has you select a card from the supply, which you then gain; that means the selection is limited to the cards on top of supply piles. Smugglers has you select a card from a remembered list (which may include cards not/never in the supply), then you try to locate a (the?) copy of that card on top of a supply pile and gain it. If there's not one there, well, you tried.

Important to note that the card that "must come from the supply" is the one that is gained, not necessarily the one that was attempted to be gained.

If the card was gained, then it most assuredly came from the supply.

That is about from where you actually can gain the card. Not what cards you can choose. (But later in the same faq it answers that question as well, the same way as above -- that is you can choose something that you then can't gain.)

Not necessarily--Thief, Noble Brigand, Graverobber, Rogue, Tournament, Bandit Camp, etc all gain from outside the Supply.

Thus, if the previous player played Thief, and gained a Supply card like Gold, you can gain a copy with Smugglers, but if he gained a non-supply card like Spoils or Diadem, you can still try to Gain it, but you will fail to do so.

I.e. does Trader's 'would gain' trigger before or after you check to see if the card you 'would gain' is actually in the Supply?

I'm no Donald, but I would assume "would gain" would only trigger if you would gain the card.  In the case of choosing Spoils when you play Smugglers, you would not gain the card.

(the density of 'would' in this post is very high)

If you choose a non-Supply card for Smugglers, you can't use Trader then, because you aren't actually about to gain anything. Similarly you can't use Trader if the Supply pile is empty.
